2- TOPIC
The subject of this agreement is the sale and delivery of the product, the characteristics and sales price of which are specified below, ordered electronically by the BUYER from the SELLER's website [[sozlesme.SiteDomain]], and the determination of the mutual rights and obligations of the Parties in accordance with the provisions of the Law No. 6502 on Consumer Protection ("Law No. 6502") and the Regulation on Distance Contracts.

4. PAYMENT METHOD
4.1. PAYMENT BY CREDIT CARD
a) When the BUYER chooses the credit card payment method, they will enter their credit card information on the relevant page before completing their purchase on the (INTERNET) website.
b) The BUYER may choose any of the available installment options, to the extent convenient, or make the payment in a single installment.
c) The BUYER's bank may offer campaigns allowing for a higher number of installments than the selected number, or provide services such as installment deferral. Such campaigns are at the discretion of the BUYER's bank, and if the SELLER is aware of them, information about the campaigns is provided on the (INTERNET) website.
d) If the BUYER chooses one of the installment options, the total order amount will be divided by the number of installments and reflected on the BUYER's bank statement from the credit card statement date. The bank may not distribute the installment amounts equally across the months, taking into account fractional differences. The creation of a detailed payment plan is at the discretion of the BUYER's bank.
e) On the other hand, since installment sales are only made with credit cards issued by Banks, the BUYER acknowledges, declares, and undertakes that they will separately confirm the relevant interest rates and information regarding default interest from their bank, and that the provisions regarding interest and default interest will be applied within the scope of the credit card agreement between the Bank and the BUYER, in accordance with the applicable legislation.
f) In the event that the BUYER defaults on transactions made with a credit card, the BUYER shall be liable to pay interest and be responsible to the bank in accordance with the credit card agreement between the BUYER and the bank. In the event of default on the debt, the BUYER agrees and undertakes to pay the SELLER for any loss and damage incurred due to the delayed performance of the debt.
g) The BUYER shall be responsible for the accuracy of the card information provided during the credit card payment process.
h) In cases where payments are made using the credit card payment method and the card is used illegally by someone other than the cardholder, action will be taken in accordance with the provisions of the Bank Cards and Credit Cards Law and the Regulation on Bank Cards and Credit Cards.
4.2. PAYMENT BY BANK TRANSFER/EFT
a) If the BUYER chooses to pay by bank transfer/EFT, the SELLER's bank IBAN information will be shared with the BUYER via the Website.
(b) The order will be confirmed after the BUYER makes the payment via bank transfer/EFT and the payment reaches the SELLER's bank account. The BUYER must write the order number in the description section of the transfer transaction.
4.3. PAYMENT VIA VOICE RESPONSE SYSTEM
a) For purchases made by telephone, the BUYER will be directed to an automated voice response system for payment and will enter the requested credit card information to complete the payment.
b) The BUYER will be notified when the payment is completed via the automated voice response system.

a) The product will be delivered to the delivery address specified by the BUYER, or to the person/organization at the address indicated, in its original packaging and in good condition.
(b) In the event of war, natural disaster, riot, strike, lockout, flood, fire, earthquake, or other circumstances beyond the SELLER's control and which could not be prevented by reasonable measures, this period may be extended.
c) Even if the BUYER is not present at their address at the time of delivery, the SELLER will be deemed to have fulfilled their obligation completely and fully. Therefore, the SELLER is not responsible for any damages or expenses arising from the BUYER's late receipt of the product and/or failure to receive it at all.
d) If the PRODUCT is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if the recipient refuses delivery.
e) Delivery to islands is not possible.
5.1. DELIVERY BY THE TRANSPORTATION COMPANY
a) When the products to be shipped are ready for dispatch, our customer service will contact the BUYER to determine a suitable week for delivery. The confirmed delivery date will be scheduled for a day within the 7-day range selected by the BUYER, as determined by the SELLER. a) 1-3 days before the scheduled delivery date, the BUYER will be contacted via SMS or phone call to obtain their confirmation.Delivery schedules are automatically generated by the system and are therefore not subject to change except in special circumstances.
b) On the day of delivery, the BUYER will be contacted and informed before the delivery attempt. In cases where the BUYER is unavailable due to special circumstances or if no one is present at the specified address and delivery cannot be completed, a second delivery will be rescheduled for at least 7 days later, and the SELLER may request an extra shipping fee for the new delivery arrangement.
c) For deliveries that include installation, installation will be done on the same day as delivery. Installation cannot be scheduled for a different day.
d) If a problem is noticed during delivery, the problem must be noted by the BUYER on the delivery form provided by the delivery team.
e) If an elevator needs to be hired due to the building not having a freight elevator or the product not fitting inside the building, the responsibility lies with the BUYER.
f) For shipments made via a shipping company, the delivery fee to all provincial centers and nearby districts is the responsibility of the SELLER. For districts far from provincial centers, the intermediate transportation fee will be paid by the BUYER.
g) For international deliveries; delivery is made to the building entrance. Since transportation is carried out by truck, if the truck cannot approach the building entrance, delivery will be made to the nearest point where the truck can.
5.2. DELIVERY BY CARGO
a) When your products are shipped via freight logistics, you will be notified via SMS when they are dispatched.
b) Thanks to our agreement with the transportation logistics company, your items are delivered to your apartment free of charge. No extra fee will be charged for delivery to the floor.
c) The BUYER is responsible for inspecting the product upon receipt and, if any problems caused by shipping are found, for refusing the product or having a report drawn up by the shipping company representative. Otherwise, the SELLER will not accept responsibility.
d) In villages, towns, or locations far from city centers where courier services cannot deliver, your package will be brought to the nearest central branch, and the BUYER will be notified to pick it up from there. The BUYER must pick up the package within the specified time.
6. INSTALLATION SERVICE
a) In deliveries made by freight logistics, the products will be assembled by our installation teams within a maximum of (3) days after the BUYER notifies the SELLER that they have received the products.
b) On the day of installation, you will be contacted and informed before the installer arrives.
c) For deliveries made via a shipping company, installation teams are sent along with the shipment, and the products are assembled on the same day as the delivery.
d) For products where installation is the responsibility of the customer, if no additional installation service has been purchased, the assembly process is the responsibility of the BUYER.
e) Service plans are automatically generated by the system, therefore no changes can be made except in special circumstances.
f) In case of return of assembled products, the disassembly of the product is the responsibility of the BUYER.
7. ORDER CANCELLATION
The BUYER may request free cancellation or exchange of products that have not yet been delivered within 3 days of the order date. For cancellation requests after the 3rd day, the terms and conditions of Withdrawal, PRODUCT RETURN AND EXCHANGE apply.
8. RIGHT OF WITHDRAWAL, PRODUCT RETURN AND EXCHANGE
a) The BUYER has the right to withdraw from the contract for STANDARD PRODUCTS within 14 (fourteen) days from the delivery date without giving any reason and without paying any penalty.
a-1) The consumer's right of withdrawal period begins on the day the BUYER receives the PRODUCT in contracts relating to the delivery of goods.However, the BUYER may also exercise the right of withdrawal during the period between the conclusion of the contract and the delivery of the PRODUCT.
a-2) In determining the withdrawal period; for goods that are the subject of a single order but delivered separately, the day the consumer or a third party designated by the consumer receives the last item is considered the delivery date; for goods consisting of multiple parts, the day the BUYER receives the last part is considered the delivery date.
a-3) You can submit your cancellation request before the cancellation period expires by sending an email to [email protected] or by calling our call center at 02166315190.
a-4) After the expiration of the buyer's right of withdrawal period, arbitrary returns are not accepted for STANDARD PRODUCTS.
b) The buyer cannot exercise the right of withdrawal for CUSTOMIZED PRODUCTS (products manufactured to order according to the customer's requests or personal needs; products that are not purchased as a ready-made product but are produced with specifications and dimensions; products that are customized by making changes or additions to the color, fabric, size, etc.).
c) For product return requests, products delivered by cargo will be collected by our own delivery team, while if products were delivered by cargo, product returns must be made by the BUYER via cargo.
d) Returns must absolutely be made with the original box or packaging.
e) Returns of products whose original box/packaging is damaged, incomplete, has lost its resale value, or is in a condition that prevents it from being sold to another customer are not accepted.
f) Returns are not accepted for disassembled products after assembly.
9. WARRANTY COVERAGE AND AFTER-SALES SERVICES
a) The product sold is covered by a 2-year warranty from CADDEYILDIZ MOBİLYA.
b) If a defect is discovered in the PRODUCT, the SELLER undertakes to resolve the issue within 30 days. Defects found at the time of delivery must be reported to the SELLER at the time of delivery.
c) Issues arising from the buyer's misuse are not covered under warranty.
10. REFUND PROCEDURE
a) The payment process for ORDER CANCELLATION will be initiated within 7 business days following the BUYER's submission of the request.
b) The refund process for product returns will be initiated within 7 business days of the product reaching the seller.
10.1. REFUND FOR CREDIT CARD PAYMENTS
a) The Bank will refund the BUYER in installments, according to the number of installments the BUYER used to purchase the product. The method of refund by the Bank to the BUYER is between the BANK and the BUYER, and the SELLER has no responsibility in this regard.
b) After the SELLER pays the full product price to the bank in a single payment, in cases where installment payments made through the bank's POS terminals are refunded to the BUYER's credit card, to prevent any party from being disadvantaged, the requested refund amounts will be transferred to the cardholder's account by the bank in installments. If the refund date and the card's statement date do not coincide, one refund will be reflected on the card each month for the installment amounts paid by the BUYER until the cancellation of the sale. The BUYER will receive a refund for the installments paid before the cancellation for the same number of months after the sale installments are completed, and this amount will be deducted from their current debt.
c) In the event of a return of goods or services purchased with a card, the SELLER cannot make a cash payment to the BUYER in accordance with the agreement made with the Bank. Refunds for payments made by credit card will be made to the same credit card.
10.2. REFUND FOR PAYMENTS MADE VIA BANK TRANSFER/EFT
a) The buyer is requested to provide bank account information, and the transfer is made via wire transfer or EFT to the account specified by the buyer (provided that the account is in the name of the person at the billing address or the user member).
11. GENERAL PROVISIONS
a) The BUYER declares that they have read and are aware of the preliminary information regarding the product subject to this contract on the website www.inegolstoremobilya.com and that they have provided the necessary confirmation electronically.
b) Prices are subject to immediate change depending on market conditions or ongoing promotions.İnegöl Store Mobilya reserves the right to change product prices and/or campaign terms and end dates at any time and without prior notice.
c) The SELLER is responsible for delivering the product in good condition, complete, conforming to the specifications stated in the order, and, if applicable, with warranty documents and user manuals.
d) Delivery of the product subject to this contract is conditional upon payment of the contract price using the payment method preferred by the BUYER. If, for any reason, the product price is not paid or is cancelled in the bank records, the SELLER shall be deemed to be relieved of its obligation to deliver the product.
e) If, after delivery of the product, the buyer's credit card is used fraudulently or illegally by unauthorized persons due to no fault of the buyer, and the relevant bank or financial institution fails to pay the seller the product price, the buyer is obligated to return the product to the seller, provided that it has been delivered to the buyer.
f) In the event that products sold with or without a warranty certificate are defective (faulty, broken, etc.) or malfunction or break down within the scope and conditions of the warranty, the products in question may be sent to the SELLER for necessary repairs by an authorized service center.
g) If the BUYER fails to pay for the ordered product or if the payment cannot be collected due to insufficient funds in the credit card account, the product sale will not take place. The BUYER acknowledges, declares, and undertakes that the order processing time is not the moment the order is placed, but the moment the necessary payment is collected from the credit card account or the payment is made, and that the SELLER is not obligated to provide any product if this collection cannot be made.
h) The SELLER is not responsible for price and content errors resulting from typographical and system errors that may occur on the Website.
12. DISPUTE AND COMPETENT COURT
a) In disputes arising from this contract, the Consumer Arbitration Board or Consumer Court located directly in your place of residence or where the consumer transaction took place shall have jurisdiction, within the monetary limits determined by the Ministry of Customs and Trade.
13. EVIDENCE AGREEMENT
a) In resolving any disputes arising from this Agreement and/or its implementation, the SELLER's records (including records on magnetic media such as computer and audio recordings) shall constitute conclusive evidence.
14. EFFECTIVE DATE
a) Upon acceptance and approval of this Agreement and completion of payment for the order placed through the Website, the BUYER shall be deemed to have accepted all the terms and conditions of this Agreement, and this Agreement shall enter into force.
(b) The BUYER acknowledges, declares, and undertakes that they have been informed by the SELLER, in a clear manner compliant with the internet environment and Law No. 6502, about the SELLER's name, title, full address, telephone and other contact information, the basic characteristics of the service subject to the Contract, the sales price including taxes, the payment method, all preliminary information regarding the service subject to sale, the right of withdrawal and how to exercise this right, the official authorities to which complaints and objections can be submitted, and all rights and obligations arising from the contract; that they have accurate and complete information on these matters; that they have confirmed this preliminary information electronically and subsequently placed an order; that they have accepted the terms of the Contract and are a party to it; and that they have no objections.
